The home secretary has said she is "committed" to a policy of sending asylum seekers more than 4,000 miles away to Rwanda, after an eleventh hour decision in the European Court of Human Rights (ECHR) blocked last night's planned deportation flight.

Priti Patel said she welcomed decisions made in the UK's domestic courts to remove migrants form the flight, but said it was "disappointing and surprising" to learn of the ECHR's intervention.

Downing Street said the government will do "whatever it takes" to ensure deportation flights to Rwanda go ahead and "all options are on the table" - including leaving the European Convention on Human Rights.

The Rwanda flight - which had up to seven people on board by Tuesday evening - had been due to take off at around 10.30pm from a military airport in Wiltshire but last minute decisions by the ECHR meant all passengers had their tickets cancelled.

Despite the government's attempts to reduce Channel crossings, around 150 more people were brought ashore in Dover on Wednesday as low winds create ideal weather conditions for such attempts.

The home secretary has insisted that the UK remains committed to the Rwandan deportation policy, saying that "preparations for the next flights have already begun".

Number 10, asked if the government could withdraw from the European Convention on Human Rights, said: "We are keeping all options on the table including any further legal reforms that may be necessary.

"We will look at all of the legislation and processes in this round."

The Attorney General Suella Braverman told ITV's Peston show "every options is on the table" when asked about pulling out of the ECHR on Wednesday, adding that the government was "not ruling anything out".

"There is huge concern about what has happened... nothing is ruled out".

The ECHR - which is not a European unx body - is part of the Council of Europe, which still has the UK as a member.

The ECHR granted injunctions for three of the migrants and the remaining four migrants were removed from the flight after being granted injunctions by UK courts or on modern slavery grounds.

Court of Appeal judges granted the injunctions - temporarily preventing the removal of the men - to three asylum seekers whose challenges were dismissed at the High Court on Tuesday.

On Wednesday afternoon, the court confirmed that three judges held an urgent hearing at 9.50pm yesterday – just 40 minutes before the flight was due to take off from Wiltshire.

Maha Sardar, a barrister at Garden Court Chambers, was one of the legal team who represented the asylum seekers due to be removed on the flight.

Garden Court Chambers

She told ITV News: "The prospect of being forcibly removed to a country which is alien to you and to which you have no connection is extremely traumatic.

"There was a huge collective sigh of relief in the courtroom when the flight to Rwanda had been cancelled. As lawyers understandably we have serious concerns for our clients’ physical and mental welfare, both en route, and when they arrive in Rwanda."

Ms Sardar said the Rwanda policy "fails to acknowledge the humanity and dignity of those who look to the UK for international protection."

"We want the UK government to support individuals and communities facing war and persecution unconditionally," she told ITV News.

"Their faith, ethnicity or nationality does not matter. What matters is that their basic humanity and dignity is being violated – the most fundamental of human values."

What legal implications does this have for the government's policy?

Those removed from the flight are being released from their immigration detention centres and will be fitted with electronic tags "while we continue to progress their relocation," Ms Patel said.

The Court of Appeal will hear applications for permission to appeal by the three men on June 28, with a full High Court review of the plan expected in July.

Ms Patel told MPs in the Commons that an "out-of-hours" judge ruled against the deportation of the flight's last remaining passengers "minutes" before departure.

She said removal directions for people on the flight have been "paused", but added: "The European Court of Human Rights did not rule that the policy or relocations were unlawful, but they prohibited the removal of three of those on last night's flight.

"Those prohibitions last for different time periods but are not an absolute bar on their transfer to Rwanda. Anyone who has been ordered to be released by the courts will be tagged while we continue to progress their relocation."

Asked if a flight could go ahead before legal proceedings in the UK are complete, Number 10 said: "That is my understanding."

The home secretary commended the UK courts for being transparent with their decisions but accused the European court of being "opaque".

In its ruling, the ECHR acknowledged concerns about access to “fair and efficient procedures for the determination of refugee status” in Rwanda, the fact that the African nation is not part of the European human rights frxwork and the absence of “any legally enforceable mechanism” to return migrants to the UK if there is a successful legal challenge to the policy.

Ms Patel said she would not let the "usual suspects" or "mobs" - an apparent reference to lawyers and opposition MPs - prevent asylum seekers being sent to Rwanda.

She added: "We will not accept that we have no right to control our borders, we will do everything necessary to keep this country safe and we will continue our long and proud tradition of helping those in genuine need."

There have been calls from within the Tory party for the UK to leave the ECHR, which is not a European unx institution and Britain's membership was not affected by Brexit.

Will the UK leave the European Convention on Human Rights?

“Our legal team are reviewing every decision made on this flight and preparation for the next flight begins now," she said.

She described the ECHR's intervention as “very surprising”, adding that “many of those removed from this flight will be placed on the next”.

On Tuesday Prime Minister Johnson suggested he could pull the UK out of the European Convention on Human Rights in order to force through deportations and on Wednesday his spokesman did not rule it out.

Number 10 said "all options are on the table...we will look at the role of the ECHR", when asked about the possibility of leaving it.

The PM said: "Will it be necessary to change some laws to help us as we go along? It may very well be and all these options are under constant review."

That suggestions sparked fury on social media, with people on Twitter calling it "disgraceful" and "disgusting".

But Health Secretary Sajid Javid did not rule out when asked on Wednesday whether it was something the UK was considering.

He said leaving the ECHR is "of course not" the only solution to legal decisions against the deportations but dodged the question when pressed for a direct response.

Instead he said the UK was determined to continue with the policy and is prepared to fight the decisions in the courts.

Power.
What happens if you put utterly self-serving people in a position of authority? They use it to further their own interests. They got into power on the back of a radical populist movement operating (as they all do) on the premise that nothing must stand in the way of "the will of the people" (as defined by them, of course). Not institutions. Not the rule of law. No procedure. No treaty. No moral or ethical principle. Definitely not its political opponents, who are not speaking for "the people" and are therefore illegitimate. This dynamic, and the implied rejection of the rule of law and political pluralism explains why radical populist movements and the governments they bring about almost always go on to attack democratic institutions (of which human rights are an integral part).
What you see now is an attempt to repeat the process: take a divisive policy (the Rwanda deportations) and use that division to rally round your supporters against the chosen enemy. In this case, the enemy will be immigrants, human rights and any institution or person that defends them because they think the people who vote for them generally dislike immigration. Whether the target audience is radical MP's in their own party who want the ECHR gone or voters who want immigrants out, the principle is always the same: radicalize and mobilize your supporters behind you to gain political power (or in this case: hang on to it a little longer). The fact that removing the ECHR would remove yet another restraint on the UK executive is an added bonus.
The decision to pick another fight with the EU is another, parallel, attempt at doing the same thing.
Divide and rule, essentially. The only factor that matters when sexting the wedge issue is that it must unite their supporters. Nothing else, neither the consequences or the ethical implications, ultimately matters. After all: they're not there to govern the country for the benefit of its population. They're there for the status, wealth and attention they derive from it.

The ‘human rights convention’ is massively skewed in favour of the pro-immigration lobby. What about the ‘human rights’ of the British people to live in their own country and have it not ruined by criminals who have no respect for our culture and don’t even speak our language?
A nation that allows everyone to be a citizen is nothing more than a landmass. The idiots who are lobbying for mass immigration are really just asking for more crime, social disunity, and chaos. They do not have our best interests at heart. Britain is for Brits. Not for these so-called ‘refugees’-who by the way come mainly from France-which is NOT a country that is at war. Only people with actual documentation and genuine refugee status should come here-and that is on the proviso that they return to their country once the situation is calmed down.
I do not want more homeless people on the streets hassling me for money. I don’t want more rapists, child molesters and terrorists here, thank you very much. Send them back. They contribute nothing to this country. We have enough of a housing shortage and enough crime as it is, let’s not make the situation worse okay.

It is actually the safe countries that migrants travel through to attempt to reach the UK is the real issue.
Whether we should take a quota as part of some joined up thinking is a different issue.
The problem also is the legal aid firms that abuse this legislation.
All legal immigration welcome but you can't just turn up without a valid claim, expect to stay at UK expense and get free legal representation. Oh no wait....

This is exactly what the racist old dinosaurs have voted for. They want to drag England back to the Victorian error. I look forward to the government introducing child labour to increase efficiency.
Every Tory should be absolutely ashamed. This country has had its heart ripped out in just 12 years based on a broken ideology which needs to constantly degrade democracy to continue to rule. Racist fascists are very much in charge of the country and at least 10 million people will vote for them in the next election.

Fluffy-Composer-2619
Even after whittling the list of deportees from 106 down to 31 and eventually 7, one of those remaining was a former Iranian police officer who was tortured for refusing to open fire on peaceful protesters.
We literally handed over $160 million in advance to the Rwandan government for them to take people who want to work in our country, to work in their country instead. Not only is it a backwards policy supposedly designed to counter human trafficking, it is a human trafficking policy in reverse. We are paying a foreign government to forcibly place people in work, where they will have no say in where they work or how much they get paid.

We're facing the worst cost of living crisis in decades and are on the brink of a recession, having never really recovered from the previous one. Yet the government's priority is laying on flights to send a handful of asylum seekers to an authoritarian dictatorship and starting an ideological trade war with our biggest trade partner.

And you have missed the entire point of the ECHR. Its literally your human rights. If they get rid of them the police can come to your house in the middle of the night, charge you for a made up crime, not allow you a trial and send you off to Rwanda.
This isn't just about refugees anymore, it's a cover up for something THAT sinister. They won't care if you're British, don't agree with the government? Deportation.

Setting aside the human rights convention, for a moment.
Maybe I'm missing something with this Rwanda plan. Can someone please clarify exactly what is unethical about this? These migrants are looking for a peaceful country which will accept them and allow them to make new lives for themselves. Rwanda is offering that.
Seems to me that the only criticism is that Rwanda is relatively poor. But that should only matter to an economic migrant, not a refugee.
