The Beetle is still a very common kit platform, and there’s a good reason why.
Ferdinand Porsche had no way of knowing it, but he hardly could have designed a better platform for kits. Beetles are cheap, lightweight, easy to find, easy to work on, and have massive aftermarket support. Most importantly, the chassis is basically a giant skateboard. Most cars today are monocoque (the body and chassis are one piece) and most older cars sit on some sort of ladder chassis (the body, chassis, and drivertrain are more difficult to separate). With a Beetle, you can unbolt the body, and pretty much just drive the chassis away (which is exactly what pre-Manx dune buggies were: just a rolling chassis with a crude roll bar bolted to it). Other than the gas tank and the support bracket for the steering column, basically everything the car needs to run is attached to the chassis, making the installation of the new body a snap.

When it comes to patents, copyrights, and trademarks, the question isn’t so much “Is it legal? ” as it is “Will the owner do anything?”. If not, then it’s not like any government is going to come after them.
Ferrari, Lamborghini, and Mercedes-Benz are very protective of their brands. They crack down on replicas all the time. Other manufacturers are more lenient, or don’t seem to care at all. Ford/Shelby doesn’t seem to be doing much about all of those unauthorized AC Cobra kits out there. There’s a company in Canada that has been making Kubelwagen replicas for years, and Volkswagen has been oddly silent on the matter, possibly because they don’t want to draw any more attention than necessary to how their company was started and what most of those first Volkswagens were used for.
I don’t think even Lamborghini, Ferrari, or Mercedes-Benz would come after a movie studio for building a replica meant to be destroyed. These are props, not a commercial product that somebody is selling to make money off of something they don’t own and/or harm the owner’s brand. These kits probably aren’t available for purchase to the general public, and I wouldn’t be surprised if they were made by the studios themselves or farmed out to a customizer. If anything, the manufacturers likely prefer it this way to destroying their actual cars, especially if it’s some priceless classic that they don’t make anymore (i.e., the Ferrari replica that was destroyed at the end of Ferris Bueller’s Day Off). Ferrari has been known to pressure their customers into removing modifications that they don’t like (like the Nyan Cat wrap on Deadmau5’s 458) and make the buyers of new Ferraris sign a contract that gives the company right of first refusal if the owner decides to sell the car later, I can’t imagine that they want people to intentionally destroy their cars.
As for the Brazilian replicas, there’s no way they’d let that slide. Those cars were being sold to the general public and wouldn’t pass the “idiot in a hurry” test, even if nobody was trying to pass them off as the real thing.

I don't know about the luxury cars apparently crashed for movies production but the more mundane cars are crashed in large number. I had a Subaru and got an offer to sell for more than I was actually asking. I thought is some scam until the flatbed showed up and the driver started counting the money without even looking at the car. They actually did destroy an original Audi R8 in a movie. I saw this on Nat Geo in Mega Factories. Audi gave it away to them to use it in the movie and destroy it. And they could not totally destroy it the way director wanted because of it’s aluminum body and other safety tech.

‘Miami Vice’ did this in the early 80’s. The black ‘Daytona’ was a custom build, with an American V8. There were, IIRC, 2 beauty versions (for close ups) and one stunt version. If you look carefully at the car scenes, you can spot the different cars, as the Ferrari badge moves from the bonnet (hood) to the front panel, and the plexiglass light cover on some scenes is missing.
When Ferrari lent them a couple of real Testarossa’s, they produced a kit car ‘stunt’ version for stunt work, again using an American V8.
The ‘Hardcastle and McCormack’ series did a similar thing, using a McLaren sportscar body, with a Porsche V8 (from a 928). As the Porsche engine was so quiet, a Ferrari ‘growl’ was dubbed in, during post production editing.
