Not a branch, about half the trees pecans land in my yard. No problem, I like them and pick them up. One day he bullies up on me and says “Hey, those pecans fell from my tree, I want to come over there and pick them up.” I said “ Not a problem with that. They are truly yours,,,, by the way, when you come over to get them, bring your rake and leaf bags… All these leaves are truly yours too.

Actually, legally what hangs over your side of the property line is yours. The OP could legally cut the branches at the property line. The tree owner would be trespassing, if he goes on your property to collect them. Especially if there's a fence.

And it's actually NOT TRUE, so be careful. You can ask a neighbor with a tree for them to cut it. You can ask if you can be relieved of responsibility for cutting it. But if you cut a neighbors tree, EVEN if on your property, AND IT DIES, you can be held responsible. Sounds crazy, I think it is too, but that's the law in my state. Check yours before cutting.
The other poster had it right…best to try to be neighborly with such things and talk them out amicably.
By the way…. It's different with FALLEN fruit. If it falls on your property, it's yours. So just wait for it. If they come over to get it.. Or pick it…without your permission, they're trespassing. And awfully greedy.

In most places within the USA, the property line divides who’s property things are…so the tree when on the neighbor’s yard is theirs, ANY overhanging branches, and the fruits they produce are yours for your consumption. (And the leaves are yours to rake…sadly.) This also means that if you don’t want the branch over your yard (Maybe it drops things in your pool?) you can legally chop it off at the dividing line point

You are correct. I lived next door to an attorney who planted a tree right next to the fence, and when it matured the leaves were a constant problem for my pool. Butthead next door finally moved. I bought the property. Has the lots resurveyed adding six feet to my property giving me both sides of the figs. I put up a fence about three feet on the other side of the trees on the other side of the new property line essentially adding a new fence near the new property line. I enjoy them ALL. For each jar we get we take one of ours and take to churches, schools, police and fire, and nursing homes. This way we get to see many smiles and get many hugs.
If I develop diabetes I guess I'll go pretty quickly. With a smile on my face and fig jam in my beard.

Not really. It's perfectly ok (& legal) to keep any fruit, flowers, etc that is on your side of the fence. It is neighborly to give it to the neighbor whose tree (or plant) it is. It is also neighborly for the tree owner to just let the invaded yard owner take the fruits that are there. It can be worked out between the neighbors. No one needs to be nasty.

I didn’t say to be nasty. But the guy didn’t ask if he could pick them up, he said they were from his tree and he wanted to come over and pick them up. He didn’t offer to give her any, or to clean up the mess on her side. I share fruit with my neighbors all the time, and my tomatoes and lemons and oranges aren’t anywhere near a fence. And I don’t mind that the leaves from their tree falls on my side. But from the story, this guy was not looking to be neighborly, just to be selfish.

When I was in high school a fellow with a large pecan orchard dammed up a creek to water his pecan trees. The growers that had pecan trees down stream of him asked him to allow some of the water to flow down stream so they could water their pecan trees. He stayed that possession was 9/10 of the law. They took him to court.
Before the trial date a large storm came up. It knocked the pecans out of this man’s pecan trees. The storm dumped lots of water on these pecan trees. They floated down stream and became lodged in a hog wire fence that had many sun flowers growing up through it at an oxbow. The growers down stream all agreed to help each other collect the pecans and share the windfall based upon the number of trees each had.
The fellow upstream took them to court as he was left out of the arrangement. It went to the same judge. The cases came up on the court docket on the same day back to back. The first case was the possession of the pecans the judge said 9/10s possession is the law. When the fellow protested the judge immediately opened the second case and ruled that 9/10s possession was the law. The fellow protested, the judge pointed his finger at him and said maybe you should get along with your neighbors. Case dismissed.

In our part of the woods anything overhanging your fence belongs to you by law. You can pick the fruit or cut the branches. The arrangement saves a lot of hustle. Neighbour planted his tree right next to his fence? No problem. I am compensated for his branches in my space by the fruit. At the same time he will not demand to enter my yard to pick the fruit. Common law has it that if part of that tree is over the property line/fence, that side of the tree is yours. I had a beautiful Japanese maple tree I had nurtured for 20 years in the southeast corner of our backyard. Made a great shade tree and I had a little sitting area underneath it.
One day, I came out and there was much more sunlight coming through the crown than the day before. I looked down our back fence and the neighbor had pruned the tree right at the fence line straight up. Not the best pruning job, but within his rights. It actually made the crown thicker the next year.
So pick away, unless there is specific laws in your location against that.

Sorry bad answer, you can take fruit off the branch over hanging your yard as the fruit will fall there anyway via gravity. However, you can only take that fruit, the rest of the tre belongs to him.
Take my word for it, it’s better to cultivate good neighbors than worry of some silly piece of fruit.

I think it would be courteous to ask first before you take any fruit.
I used to live in Florida, and had a home with a couple of mango trees, two avocado trees and a pineapple plant. The one mango tree was in the front yard as was the pineapple, and people came by and stole without asking. Our backyard was fenced but the larger mango tree was close to it and people regularly walked by and started hitting my tree with sticks to get mangoes to fall.
Thing is, I was happy to share with people, I just wish they would have asked me first. When I picked fruit there was so much I would bag it up and walk it round to the neighbors giving it away. And one time, an older gentleman came to my door with a bag and what looked like a field hockey stick and politely asked me if he could have some mangoes. I unlocked my gate and let him have as many as he could carry.
So I think that in an effort to be polite and friendly with your neighbors…ask first.

I had a customer for a landscape job that ran into this problem. This was in metro Atlanta. They happen to be peach trees but they weren't taking fruit. The customer has a rather small back yard and these trees were about 12-18″ behind the fence/property line with branches hanging over into their property by a good 3 feet. I believe there were just 2 trees and we're talking 4–5 branches total.
My customer had a previous landscaper/gardener prune the limbs back to the main stem(trunk) at the root collar (the wrinkly part at the joint) In otherwords, they were pruned correctly according to horticulture practices and the health of the tree. The remaining tree still looked healthy and complete in my professional opinion. For those of you that don't know, most peach trees grow somewhere irregularly, so it's harder than some trees to detract from their ornamental value.

Because my client had the nerve to do this, the neighbors sued them. My client learned, as did I get confirmation on the particulars, is if they had left ugly 12–18″ nubs, potentially creating a vector for disease and an eye sore, they would have been within their rights and the neighbor would have had no ground for the lawsuit. The law, at least in this municipality, was any vegetation that hangs over the property line is fair game up to that property line. So an imaginary vertical line would need to be drawn from the property line straight up and you can do as you please up to that imaginary line.
Here is the lesson at the end of the day though. First, talk to the folks with your municipality and see what the law and applicable codes are. Then…Ask your neighbor before you do anything! Even if you know you are within your rights.
People are funny about their plants, and I get it to an extent. This is just one of many experiences I've had with an ornery plant loving neighbor. Tread lightly.

Why not ask the neighbor how he feels about it? In order for him to pluck that fruit, he'll have to be granted access to your yard. It should be easy to reach an amicable decision.
But if you are forced to go to war over it, bring a tree expert to lop off branches at the property line while making sure not to injure the tree. And it wouldn't hurt to consult a lawyer about local laws that might apply.

If your neighbor has a fruit tree, and that branch is over the fence on your side, it is okay to pick that fruit. On the other hand, if you are climbing up a ladder and going over and picking your neighbor's fruit off their side of the fence without asking permission, that is completely rude.

We’ve got a lemon tree that keeps growing over the fence and I sure wish my neighbor would pick the fruit that’s over on his side of the fence. It helps the tree to provide more fruit rather than butchering the branches at the properly line.
